ESTATE OF NORMAN G. WENNAGEL FAMILY TRUST. (12/4341/E) — Before the court is a motion, pursuant to CPLR 3211(a)(4),(7), and (8), to dismiss a petition for limited letters of trusteeship. For the reasons set forth below, the instant motion to dismiss is denied and limited letters of trusteeship shall issue to petitioner, Lynn Barsigian upon due qualification.

The underlying petition seeks limited letters of trusteeship pursuant to SCPA 702(8), and (9) for the purposes of bringing an action against Jeanette Capriola and Walk in Love for Jesus Church, Inc., and/ or Walk in Love for Jesus to recover trust assets. Petitioner alleges that Jeanette Capriola, while serving as the trustee of the Norman G. Wennagel Family Trust, made certain improper conveyances to herself and/or the Walk in Love for Jesus Church (“the church”) of trust funds.
