The Equal Employment Opportunity Commission has lost its appeal of a case alleging that the Port Authority of New York and New Jersey paid some of its female attorneys far less than their male counterparts.

A three-judge panel at the U.S. Court of Appeals for the Second Circuit said Monday that the EEOC, despite a three-year investigation, failed to plead “any facts particular to the attorneys’ actual job duties,” and sued on the assumption that the attorneys were engaged in the same level of work.
