The Appellate Division, Second Department, Wednesday dismissed a suit against New York City by the parents of a 10-year-old girl who drowned at a Coney Island beach in July 2008.
Ruling in Johnson v. City of New York, 23959/09, that lifeguards who attempted to rescue Akira Johnson were sufficient in number and “adequately trained,” the panel overruled Brooklyn Supreme Court Justice Carl J. Landicino (See Profile), who had let the case go forward.
