A Starbucks customer who sued for negligence after she sustained severe burns from a spilled cup of coffee may proceed with her case, an Eastern District judge has ruled.

The plaintiff, Devrim Cacin-Worthy, was burned in November 2011 when the lid popped off her coffee moments after a Starbucks employee handed it to her. Cacin-Worthy filed a suit in Queens Supreme Court claiming Starbucks was negligent in serving coffee that was too hot and in failing to secure the lid. The case was then transferred to federal court due to diversity jurisdiction.
