In a discovery dispute during a dental malpractice case, a judge denied a defense attempt to compel authorizations for any records on matters like drug and alcohol treatment.
“Defendants have failed to establish a ‘compelling need’ for the records that would justify a waiver of plaintiff’s right to confidentiality,” Manhattan Supreme Court Justice Alice Schlesinger (See Profile) wrote in Hampton v. Universal Dental, 805088/2012.
