The estate of a woman who was shot and killed by her former boyfriend as their 4-year-old daughter looked on may proceed with its suit against an Oneida County domestic violence investigator to whom the victim repeatedly complained about threats she was receiving, a federal judge ruled.

However, Northern District Judge Gary Sharpe (See Profile) significantly narrowed the action filed on behalf of Kylie Ann Turczyn, finding in Turczyn v. City of Utica, 6:13-cv-1357, that municipal liability does not extend to the city of Utica nor its police department because the claim does not validly allege a failure to properly train police.
