The U.S. Court of Appeals for the Second Circuit was asked Tuesday to decide whether its ruling in Kiobel v. Dutch Petroleum, which rejected liability under the Alien Tort Statute for corporations that aid and abet human rights violations, is still good law.
Michael Elsner, a partner at Motley Rice, urged Judges Denny Chin (See Profile), Susan Carney (See Profile) and Robert Sack (See Profile) to reject the continued viability of Kiobel, a 2010 case that found corporations cannot be sued under the Alien Tort Statute (ATS), but that may or may not have been rendered obsolete by the U.S. Supreme Court.
