A Staten Island judge has recused himself from hearing motions to unseal testimony and evidence in proceedings that resulted in no criminal charges for a police officer in the death of Eric Garner.

Acting Supreme Court Justice Stephen Rooney (See Profile) took himself off the matter Wednesday, citing his wife’s role as board chairwoman of Richmond University Medical Center. The hospital’s emergency responders treated Garner after police officer Daniel Pantaleo applied a chokehold to him.
