ALBANY – Justice Eugene Fahey, of the Appellate Division, Fourth Department, is Gov. Andrew Cuomo’s choice to fill a seat on the Court of Appeals opened by the Dec. 31 retirement of Robert Smith.
The governor said Thursday that Fahey’s background, a mix of private practice, state judgeships and local political office, would make him a “formidable” member of the court.
