A Manhattan Commercial Division judge has granted summary judgment in favor of a leasing company whose cargo handling equipment was damaged by Hurricane Sandy.

Ruling in American Stevedoring v. Red Hook Container Terminal, 651472/2012, Acting Justice O. Peter Sherwood (See Profile) on Jan. 15 rejected various defenses offered by Red Hook Container, the operator of a 66-acre ship cargo and warehouse in Brooklyn, as to why it had failed to return leased equipment to the plaintiff.
