ESTATE OF AIELLO, Deceased. (09/994/G) — In this proceeding which has been pending for well over five (5) years, the nominated executor, Charles Aiello, (hereinafter referred to as “Aiello”), had to be compelled to produce decedent’s Last Will and Testament. After eventually filing the Will for probate, this proceeding sat dormant until Aiello was directed to appear in Court to move this matter forward, and only then were Letters Testamentary issued to him on July 21, 2010.

Almost two years later, Aiello had to be threatened with removal as fiduciary and loss of commissions before he filed the Inventory of Assets required by Uniform Rule 207.20. Finally, on May 15, 2013, Aiello had to be compelled by the Court to file a formal accounting within sixty (60) days, under threat of contempt. Only then was the accounting filed by Aiello and his attorney, Frank J. Rucci, Esq. Nevertheless, this matter dragged on for another year and a half without Aiello or his attorney obtaining jurisdiction over the necessary parties herein, despite Mr. Rucci being held in contempt.
