ESTATE OF CAROLYN ATTA, Deceased, (08/4934/A) — In this contested miscellaneous compromise proceeding, Monica Omoarukhe (the movant), as administrator of the estate of Carolyn Atta (the decedent), moves for summary judgment seeking a determination that Mohammed Atta (the respondent), the decedent's spouse, abandoned the decedent prior to her death by repeatedly sexually abusing and raping her minor daughters, and thus should be disqualified from inheriting from her estate on the grounds of abandonment. Both the respondent and his guardian ad litem submit opposition in which they assert, inter alia, the existence of material issues of triable fact regarding the allegations of the respondent's abandonment and failure to support the decedent.
