An appellate court has ordered removed from the state’s Central Register of Child Abuse and Maltreatment the name of an aspiring pediatrician who was reported for striking his 2-year-old son once on the buttock.
Writing for a unanimous panel of the Appellate Division, Third Department, Justice Eugene Devine (See Profile) said in Matter of Maurizio XX v. New York State Office of Children and Family Services, 519112, that there was no evidence the incident impaired the child’s physical, mental or emotional condition.
