ALBANY – A research scientist who was working on a federal grant when he was exposed in a New York University laboratory to the virus that causes Kaposi’s Sarcoma must seek redress from the college through the state’s workers compensation system instead of a private suit, an appeals court decided.
A panel of the Appellate Division, Third Department, unanimously upheld the decision of the state Workers’ Compensation Board that the crucial element of a work relationship existed between NYU and Paul Schwenger, making his on-the-job injuries subject to the workers comp system.
