ESTATE OF PAPPA, Deceased. (12/490/C) — In this contested accounting proceeding, Suzanne Deaton, a/k/a Suzanne Pappa, the Petitioner herein, has moved to enforce a settlement agreement between herself and Dianne Pappa, the Respondent. Furthermore, the Petitioner is moving to be appointed as Successor Trustee of the subject trust, to have Respondent deposit the trust funds in her control into her attorney's escrow account, as well as have Respondent pay $3,500.00 to Petitioner's counsel for costs associated with the instant motion. The stipulation entered into on October 8, 2014 was signed by counsel for the Petitioner, counsel for the Respondent and the court appointed Guardian ad Litem. The Guardian ad Litem supports the instant motion. Neither the Respondent nor her counsel appeared on the return date of this motion, nor has there been submitted any opposition by the Respondent to the relief sought.

The stipulation between the parties mandated that the Respondent would furnish outstanding discovery demands by November 7, 2014 and failure to do so would preclude the Respondent from submitting such documents anytime after said date. The Respondent has failed to submit the requested discovery by the mandated date and as a result is now barred from submitting any documents in relation to her accounting, claims and defenses and is precluded from offering such evidence at trial.
