The name of a law firm, like the name of any business, can have a substantial effect on the success of the firm. The good reputation that a law firm earns from its perennial diligent work and good advice can attach to the name of the firm and can create value for its partners into the future. Moreover, the name of a prominent practitioner or respected public figure whose name, upon joining an existing firm, is added to the name of the firm brings new value to a law firm’s reputation and likely enhances its business.
Being comprised of lawyers, law firms, of course, must have names that comply with the applicable Rules of Professional Conduct and relevant case law. A recent case, from West Virginia, Webb Law Firm, PLLC v. Webb Law Firm P.C.i presents an interesting fact pattern and the starting point for this month’s column which reviews some issues and limitations concerning law firm names.
