An appeals court unanimously reversed a state Supreme Court decision denying an accident victim’s attempt to file a late notice of claim against New York City for a fall she suffered in April 2012 while walking past a construction site in the Bronx.

Rose Rivera showed that her failure to file the notice within 90 days of the fall was excused by General Municipal Law §50-e[5] due to the severe nature of her injuries, the Appellate Division, First Department, panel ruled in Rivera v. City of New York, 14764N 260295/13.
