New York City is fighting the reinstatement of an $18 million verdict against police for the mishandling of a rape kit that delayed the exoneration of a man for 12 years.

The city’s Law Department has filed a petition with the U.S. Court of Appeals for the Second Circuit for a rehearing en banc in the case of Alan Newton, whose award was vacated by a district judge but restored by a three-judge circuit panel in February.
