A divided appellate panel upheld a second-degree murder conviction for a man who insisted that he was misidentified as the shooter in a 2008 Brooklyn murder and claimed his trial attorney provided ineffective assistance because he did not offer an alternative defense.

The Appellate Division, Second Department, ruled 3-2 to uphold the December 2010 murder and assault convictions for Prince Clark.
