Actress Dianne Wiest lost her bid to cut the rent on her apartment to rent-regulated levels, when the Appellate Division, First Department, rebuffed her effort to apply a pro-tenant Court of Appeals ruling retroactively.

A unanimous panel on Tuesday overturned a lower court that had applied Roberts v. Tishman Speyer Properties, 15 N.Y.3d 270 (2009) retroactively. Roberts held that New York City landlords who received J-51 tax abatements were required to adhere to regulations limiting rents.
