An administrative law judge did not err by deciding St. Barnabas Hospital was time-barred from requesting a review of an audit that found it made $5.38 million in overcharges to the Medicaid program, a state judge ruled.
Albany Supreme Court Justice George Ceresia said that contrary to the hospital’s contention, Administrative Law Judge Denise Lepicier made a reasoned judgment when she found the 60-day period the hospital had to challenge the audit review passed in 2013, before it asked for the review.
