ESTATE OF DONNA MILLER, A/K/A DONNA PAULINE MILLER, A/K/A DONNA P. MILLER, Deceased. (1088 P 00) — In this contested accounting proceeding, petitioner, JPMorgan Chase Bank, N.A. ("JPMC"), as executor of the estate of Donna Miller and as trustee of the testamentary trust for the benefit of David Miller ("David"), seeks an order: (1) approving the stipulation of settlement between JPMC as executor and the sole surviving testamentary trustee, Harry Rosenberg ("Rosenberg"); (2) discharging and releasing JPMC, with prejudice, as to all matters other than the objections or claims filed by David; (3) discharging and releasing Rosenberg and the estate of his spouse, the now-deceased co-trustee Barbara Filner ("Filner"), with prejudice, as to all matters contained in the accounting in connection with the trusts established for the decedent's sons, Blake Miller, Bret Miller, and Brad Miller (collectively, the "Miller Sons"); and (4) dismissing, with prejudice, any and all objections and/or claims that have been or may be asserted by the Miller Sons against JPMC, Rosenberg, and the estate of Filner.

This motion is supported by “Affirmation in Support of Motion to (1) Approve Settlement Agreement with Testamentary Trusts and Trustee, (2) Dismiss With Prejudice Objections Asserted by the Miller Sons, and (3) Discharge the Fiduciaries from any and all Objections and Claims Except for those Asserted by David Miller in this Proceeding” of Zachary G. Newman, Esq., attorney for JPMC (the “Newman Affirmation”) and the “Affirmation in Support of Executor’s Motion for Approval of Stipulation of Settlement” of Donald J. Farinacci, Esq., attorney for Rosenberg (and who represented Filner prior to her death, the “Farinacci Affirmation”).
