Immigration law that requires unwed fathers to live in the United States longer than unwed mothers when considering their children born abroad for citizenship is unconstitutional, the U.S. Court of Appeals for the Second Circuit ruled Wednesday.
The court found that the tougher standards violated Equal Protection Clauses and the Fifth Amendment, and concluded that Luis Ramon Morales-Santana derived citizenship at birth from his unwed father.
