The H-1B visa program is the cornerstone of our country’s nonimmigrant employment-based scheme. The program has recently come under fire for alleged abuses following layoffs of American workers in the technology services sector. Some opponents of the H-1B program have responded to the allegations by renewing their advocacy of its termination, but they fail to recognize a crucial point: Strict protections, strong enforcement mechanisms, and severe penalties for non-compliance and fraud are already in place to prevent the program from having an adverse impact on U.S. workers and the economy.

While any immigration program is vulnerable to isolated abuses, the H-1B program has proven essential to continued U.S. competitiveness in today’s global economy and marketplace for best-in-class talent. Preserving the benefits of the H-1B program requires a discussion of how best to improve the system, not destroy it all together.
