ESTATE OF FRANCES ASCH, Deceased. (13/217/A) — In this pending discovery proceeding, a dispute between two siblings continues on a treacherous path. In February 2014, pursuant to SCPA §2103, Laura E. Solomon (the "Petitioner"), filed a petition against her sister Audrey L. Silverstein (the "Respondent") to discover property that she claims was improperly taken by the Respondent from the Estate of Frances Asch ("the Decedent"). The Petitioner and Respondent were appointed Co-Executors of the Estate in March 2013, and continue to serve as such today.

ESTATE OF FRANCES ASCH, Deceased. (13/217/A) — In this pending discovery proceeding, a dispute between two siblings continues on a treacherous path. In February 2014, pursuant to SCPA §2103, Laura E. Solomon (the “Petitioner”), filed a petition against her sister Audrey L. Silverstein (the “Respondent”) to discover property that she claims was improperly taken by the Respondent from the Estate of Frances Asch (“the Decedent”). The Petitioner and Respondent were appointed Co-Executors of the Estate in March 2013, and continue to serve as such today.

In March 2015, the Petitioner brought an Order To Show Cause seeking a temporary restraining order (“TRO”) to prevent the Respondent and others acting on her behalf from: (1) transferring, using, or retitling any funds held in their names at Charles Schwab & Co. Inc.; and (2) transferring, using, or retitling any funds derived from a specific Schwab account (“Schwab”), which was formerly in the decedent’s name. Subsequently, the Court granted a TRO pending a determination on whether a preliminary injunction should be issued. The TRO restricted the Respondent or any other person from making any transactions involving the specific Schwab account.
