ESTATE OF CYNTHIA FORMIGLIA, (14/1268/A) — In this application, petitioners, Beverly Formiglia and Michael Formiglia, seek to reduce the bond required by this court pursuant to its Decision and Order dated December 10, 2014. In that proceeding, petitioners sought to establish a supplemental needs trust for the benefit of their daughter, Cynthia Formiglia ("Cynthia"). That application was granted, subject to certain conditions, one of which was the posting of a bond in the amount of $65,000.00. Pursuant to that application, Beverly Formiglia ("Beverly") will be the sole trustee of the Cynthia Formiglia Supplemental Needs Trust (the "Trust"), which will be funded with sixty-three thousand dollars from the settlement of a personal injury action.

Counsel for petitioners has advised the court that Beverly is unable to obtain a bond, as are all successor trustees. Petitioners request, therefore, that they be permitted to dispense with a bond, and instead request that the court require the trustee to file an annual account until such time as the corpus of the Trust is equal to or less than thirty thousand dollars, at which time both the bond and the annual account will be dispensed with.
