A Queens judge has ruled that the New York City Police Department is exempt from providing a convicted murderer with records pertaining to his conviction because he has a pending habeas petition in federal court.

Matthew Rodney is serving 25 years to life at the Upstate Correctional Facility for a 2007 conviction of second-degree murder and second-degree criminal possession of a weapon for the 2002 shooting death of Michael Clarke at a Queens nightclub.
