A man who has been incarcerated for about 15 years could stand trial for the fifth time for the 1996 double murder of an elderly man in Westchester County and his home health aide, a Brooklyn appeals court ruled Wednesday.
The decision by a panel of the Appellate Division, Second Department, in People v. Days, 2012-1261, reversed Selwyn Days’ conviction of two counts of second-degree murder and granted his motion to submit expert witness testimony on false confessions.
