(95/4041/A); (06/817/A) — At the call of the calendar, the court denied the motion by Melanie Tarka to vacate this court’s June 20, 2013 order granting summary judgment to the Public Administrator and dismissing Ms. Tarka’s application to set aside a stipulation settling her objections to the Public Administrator’s accounts in the estates of Wanda S. Tarka and Mark Tarka.

Movant appeared on February 28, 2012, the return date of the aforementioned summary judgment motion, and pursuant to her request, was given additional time to respond. Upon movant’s default and a determination that the Public Administrator met her burden to make a prima facie showing of entitlement to judgment as a matter of law (JMD Holding Corp. v. Congress Financial Corp., 4 NY3d 373; Andre v. Pomeroy, 35 NY2d 361; Liberty Taxi Mgt. Inc. v. Gincherman, 32 A.D.3d 276), the court granted summary judgment to the Public Administrator.
