ESTATE OF EILEEN PELLEGRINO, A/K/A EILEEN MILDRED PELLEGRINO Deceased. (11/833/A) — This is a proceeding for judicial settlement of account by the Kings County Public Administrator (the petitioner), as administrator of the estate of Eileen Pellegrino, a/k/a Eileen Mildred Pellegrino (the decedent), who died intestate on September 6, 2009. The petitioner was issued Letters of Administration on September 6, 2011, and commenced the instant proceeding on April 30, 2012. Upon filing the petition and account, the petitioner cited two alleged maternal first cousins of the decedent, four alleged paternal first cousins of the decedent, two alleged funeral creditors, the New York State Department of Taxation and Finance, the Attorney General of the State of New York, and The New York City Human Resources Administration. In addition, the petitioner duly published for all unknown distributees of the decedent’s estate, pursuant to SCPA §307(3)(a). A guardian ad litem was appointed to represent the interests of unknown distributees of the decedent’s estate. On August 17, 2012, objections to the instant accounting were filed by the two alleged maternal distributees and three alleged paternal distributees. In addition, a notice of appearance was filed by one purported funeral creditors; however, no objection to the account or claim for reimbursement of funeral expenses was filed by either alleged funeral creditor.
Counsel appeared in this proceeding on behalf of the objectants, and upon the parties’ consent, a hearing to prove kinship of the decedent was held before a court attorney-referee (the referee) on January 13, 2014. All parties have waived the filing of the referee’s report, and have stipulated to the Court’s determination of all kinship issues upon the transcript of the hearing testimony and the documents in evidence, pursuant to SCPA §506(6)(c). The guardian ad litem has completed her investigation of kinship and has submitted her report with respect thereto.
