New Hampshire law will govern the Western District of New York’s consideration of a suit against Goodyear Dunlop for allegedly manufacturing a deficient motorcycle tire blamed for an accident in Arizona, a Buffalo magistrate judge has decided.

Magistrate Judge Hugh Scott determined after his analysis of New York state and federal rulings, chiefly Neumeier v. Kuehner, 31 NY2d 121 (1972), that the victims’ domicile (New Hampshire) should outweigh the other considerations, including where the product was manufactured (New York) or where the accident involving the product occurred (Arizona), in determining which jurisdiction’s laws apply.
