ESTATE OF HAROLD ELLIOTT, Deceased. (14/1586/B); & (14/1586/C) — Harold Elliott (decedent) died on January 15, 2014 intestate, survived by a spouse and three children and four grandchildren. Letters of Administration (letters) were granted to his son, Harold Elliott (Harold) on June 27, 2014. Letters authorized the collection of assets up to $499,999.99. On December 22, 2014, Harold filed a petition to amend letters (Harold’s petition) authorizing the collection of assets up to $650,000.00, because after letters were issued, it was determined that the assets of the estate were of a higher value. Specifically, he avers that the value of the real property of the estate was increased to $310,000.00 from $300,000.00 and the value of a Merrill Lynch account (brokerage account) increased. Sabrina Elliott, the decedent’s daughter (Sabrina), filed objections to Harold’s petition (Sabrina’s objections).

Sabrina’s objections state: “First, the Petitioner has defrauded the Objectant, Sabrina Elliott prior to the Decedent’s death and is attempting to defraud the Objectant in the current proceedings. The Objectant asked the Petitioner several times to meet with the Petitioner’s lawyer, Ian Daiter for better understanding and the Objectant was always misled. The Objectant knows for a fact that the house was appraised in July 2014 not December 2014 and the Fair Market Value for comparable houses in the area is $500,000. In addition, the Petitioner was aware of the Objectant’s disability, and have been manipulating the Objectant for years. The Petitioners put the Objectant in a distressed state. In 2013, because of the Objectant’s disability she was put on work restrictions (which makes the Objectant’s income below poverty line) economically.”
