A federal judge has rejected the latest appeal from New York state officials who are being sued for imposing parole terms of post-release supervision after a court found the practice unconstitutional.
Four years into the case, with a December trial looming on damages in the class action against correctional and parole officials, Southern District Judge Shira Scheindlin called their appeal seeking qualified immunity “frivolous” and said she would retain jurisdiction to keep the case moving.
