ESTATE OF CHARLES YUNG CHANG TSE, Deceased. (12/3479/A) — This is a proceeding to hold respondent Vivian Tse ("respondent") in contempt for failure to comply with an order of this court dated January 25, 2013, directing various individuals, including respondent, to produce any and all testamentary instruments executed by decedent Charles Yung Chang Tse in their possession or under their control and further directing them to submit to an examination regarding such testamentary instruments. To date, respondent has not submitted to an examination. Her lawyer states that respondent, who is 85, suffers from significant memory problems and that any examination will be futile and may jeopardize her health. The court will hold a hearing on November 17, 2 PM, to determine whether respondent was capable of complying with this court's order when it was served upon her (in which case, she was in contempt), and if so, whether she is now capable of purging the contempt by submitting to the examination contemplated by the order without further delay.
