A Brooklyn Family Court judge erred in dismissing a neglect petition against two parents that was filed after police found individual packages of heroin and crack cocaine and a large amount of marijuana at the father’s home, an appeals court ruled.
Writing in Matter of Jaielly R. H. (Kimberly V.), 2014-11142 and 2014-11143, an Appellate Division, Second Department, panel ruled that the drugs recovered during the execution of a search warrant were in reach of the child, who was about 3 years old at the time.
