ESTATE OF ETHEL DELL, (15/413) — In this uncontested proceeding in the estate of Ethel Dell, petitioner seeks to probate two instruments, one a purported will dated January 28, 1954, and the other a purported codicil thereto dated November 29, 1968. ESTATE OF ETHEL DELL, (15/413) — In this uncontested proceeding in the estate of Ethel Dell, petitioner seeks to probate two instruments, one a purported will dated January 28, 1954, and the other a purported codicil thereto dated November 29, 1968. The respective attesting witnesses are either deceased or, despite a diligent search by petitioner, are of unknown whereabouts. Petitioner asks that the instruments be admitted to probate as ancient documents.

Decedent died at the age of 89 on December 21, 2014, survived by her son, who is petitioner herein, and her two adult daughters, her sole distributees. The propounded will, which was retrieved from the custody of a law firm, leaves decedent’s estate to her children in equal shares, contains an attestation clause, and was subscribed by three witnesses. The propounded codicil would alter the will only to the extent of appointing different individuals to serve as guardians for any minor children surviving decedent.
