ESTATE OF MARY JOAN BROWNE, Deceased. (05/3246/A) — Decedent Mary Joan Browne died intestate on October 19, 2004, and proof as to the identity of her distributees was insufficient when the Public Administrator accounted as administrator of decedent’s estate. Accordingly, a decree of this court, issued on September 7, 2007, directed that the net estate be placed on deposit, and the funds are currently held by the State Comptroller. The co-fiduciaries appointed by the High Court of Ireland to administer decedent’s estate in Ireland petitioned to withdraw the funds on deposit and sought a determination by this court as to the identity of the individuals to whom such funds should be distributed as her distributees.

The kinship proof submitted at a hearing before a court attorneyreferee established that decedent was survived by 17 individuals: Bartholomew Browne, Jr., Gerard Browne, Peter Browne (who postdeceased decedent), Marie Murphy, James Augustine Browne, Richard John Browne, Bridget Paschal Henderson, Mary Dolores O’Connor, Patrick Browne, Cecil Browne (who post-deceased decedent), Joseph Browne, Anthony Doherty, Liam O’Rourke, Elizabeth Courtney, Charles O’Rourke, Christina Marie O’Connor, and Mary Bernadette Gibson. The court is satisfied that diligent and exhaustive efforts have been made, without success, to ascertain the existence of any other distributee, that more than three years have elapsed since decedent’s death, and that no claim to kinship has been made by any person other than the above-named distributees. Therefore, pursuant to SPCA 2225, the court determines that no distributees exist other than those ascertained in the record before the court.
