A disorderly conduct charge premised on a man’s alleged involvement in an early morning street fight was faulty, a judge ruled, because it was facially insufficient.
“Just because a fight occurs on a public street does not necessarily mean that the public harm element has been satisfied,” Bronx Criminal Court Judge Armando Montano wrote in People v. Soriano, 2015BX026378.
