In civil actions involving private litigants, the filing of a notice of appeal does not automatically stay enforcement of the judgment or order sought to be appealed. Stays pending appeal are generally governed by CPLR 5519.

CPLR 5519(a) provides for stays without a court order, including stays for the state or any political subdivision of the state or any officer or agency of the state or of any political subdivision of the state, which are automatically triggered upon the filing of a notice of appeal, and stays that may be obtained by private litigants by taking certain prescribed steps, such as posting an undertaking on appeal (roughly the equivalent of an appeal bond) securing a money judgment.
