Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is ORDERED, on the court’s own motion, that the parties show cause before this court why the above-entitled appeal should or should not be dismissed as untimely and appellant has not sought leave to file a late notice of appeal (see CPL 460.10, 460.30), by filing an affidavit or affirmation on that issue with the Clerk of this court on or before January 22, 2016; and it is further,
