Gov. Andrew Cuomo has appointed Justice Gerald Whalen as presiding justice of the Appellate Division, Fourth Department.

Whalen, 59, will replace Justice Henry Scudder, who has reached the mandatory retirement age of 70. Scudder has been certificated to serve another two years on the bench but had to step down from the presiding justice position.
