Architect Hired to Provide Design and Administrative Services Relating to Construction of a Home—Contract’s Exculpatory Language Was Not Broad Enough to Defeat Homeowner’s Claims on a Motion for Summary Judgment
A plaintiff-owner had commenced an “action to recover damages for breach of contract and breach of fiduciary duty in connection with the design and construction of a custom,…house [project] upon [owner's] property….” In May 2005, the owner had signed a contract with an architect “to perform design and administrative services in connection with the project.”
