ALBANY – The owners of an upstate New York farm may not deny use of their commercial banquet facilities to same-sex couples, a state court decided Thursday, validating the state’s sanctions against them for doing so.

A unanimous panel of the Appellate Division, Third Department, said Cynthia and Robert Gifford violated Executive Law §292(9), which prohibits discrimination in public accommodations based on sexual orientation, by refusing use of their Liberty Ridge Farm to Melisa Erwin and Jennifer McCarthy for their wedding.
