Though acknowledging that the residential placement of sex offenders can create a “dilemma” for state prison officials, an appeals court said the state erred by keeping an offender imprisoned for eight months past the expiration of his sentence.

The Appellate Division, Third Department, panel ruled that the state Department of Corrections and Community Service (DOCCS) failed to follow state law by releasing William Green from Sullivan Correctional Facility in February 2015 when his three-year sentence for the attempted sexual abuse of a child ended.
