ALBANY – New York’s $19 registration and decal fees on commercial truckers violate the commerce clause of the U.S. Constitution because they are not imposed proportionally to the payors’ use of state highways, a judge has determined.
Acting Albany Supreme Court Justice James Ferreira granted summary judgment to the plaintiffs in Owner-Operator Independent Drivers Association v. New York State Department of Taxation and Finance, 5551-13, a class action filed by a trade group on behalf of non-New York state residents who sometimes drive commercial trucks on state roadways.
