ESTATE OF ROMAN BLUM, Deceased. (12/29) — Once again, in this pending probate proceeding, Emmett W. Caldwell is attempting to file with the Court yet another document consisting of numerous pages, mostly rambling, confusing and indecipherable. When viewed in a light most favorable to Caldwell, however, these numerous papers appear to be an application for Poor Person status, along with many additional papers in support of his application. Those voluminous papers were prematurely sent to the Court, and should immediately be returned to Caldwell, to be offered by him as evidence at the appropriate time.

When viewed in a light most favorable to Caldwell, however, these numerous papers appear to be an application for Poor Person status, along with many additional papers in support of his application. Those voluminous papers were prematurely sent to the Court, and should immediately be returned to Caldwell, to be offered by him as evidence at the appropriate time.

Accordingly, the Court hereby schedules a hearing for Wednesday, March 16, 2016 at 12:30 p.m., at which time Caldwell shall appear in the Surrogate’s Courtroom to testify, under oath, regarding his status to proceed as a poor person. At that time, he may offer to the Court any evidence that may be considered relevant to the issue. Furthermore, Caldwell’s motion for a stay is hereby denied without prejudice.
