Commercial Landlord-Tenant—”Good Guy Guaranty”—Landlord Entitled to Prejudgment Interest and Attorney Fees—Breach of Guaranty Claim—Failure to Timely Surrender Premises “Vacant and Broom Clean,” a Condition That Would Have Released the Guarantors From Liability—Attorney Fees Award Reduced—Block Billing, Under Certain Circumstances, May Be Acceptable—Hourly Legal Rates Within the Southern District of New York—Generally, Number of Hours Expended Was Reasonable

This decision involved “a motion to impose, on the losing party, the costs of enforcement of a contractual guaranty” (guaranty). The court previously granted the landlord-plaintiff (plaintiff) summary judgment on its breach-of-guaranty claim against the defendant guarantors (guarantors) and held that the guarantors are liable to the plaintiff for $2,067,288.89. The plaintiff then moved for “prejudgment interest” plus $309,212 for attorney fees and costs.
