A state appeals court ordered a new assault trial for a man it said was prejudiced by a prospective minority juror’s exclusion from his trial under a prosecutor’s peremptory challenge.
A unanimous panel of the Appellate Division, Third Department, said Assistant Albany County District Attorney Brian Farley gave race-neutral reasons for excluding three minorities from the jury at the 2001 trial of defendant Andrew Black, who is black.
