The First Amendment and common law require unsealing a whistleblower complaint brought by attorney Bruce Bernstein against the plaintiffs’ securities firm that spurned him: Bernstein Litowitz Berger & Grossman, a federal appeals court ruled Wednesday.

The U.S. Court of Appeals for the Second Circuit agreed that the complaint in Bernstein’s suit, which alleged he was forced out for questioning what he described as a kickback scheme between Bernstein Litowitz and lawyers in Mississippi, cannot remain a secret.
