A defendant’s fair trial rights were not violated when a jury initially acquitted him of a gun charge, returned to the jury room to remedy an incomplete verdict form and re-emerged with a verdict of guilty, a federal appeals court held Monday.

The U.S. Court of Appeals for the Second Circuit rejected claims of ineffective assistance of counsel and double jeopardy made by prisoner Jose Tavarez, who was convicted of manslaughter and a gun charge in the 2005 slaying of his girlfriend, Liliana Alvarez.
